Abstract: Trade unions are positioned differently in different countries depending on the political, economic and social systems. At the workplace, trade unions are the embodiment of the right to freedom of expression and association. This paper looks at the internal regulation of trade unions and the relationship that exists between trade unions and their members under the South African labour law. It argues that this relationship is that of an agency and requires both parties to perform in terms of the contract of membership and abide by the trade union rules or constitution.
