Abstract:

Existing Slovak Building Act does not cover land-use planning issues in sufficient detail. Its amendments aimed at protecting private property and enforcing land-use plans (particularly in form of fines and removal of buildings) are necessary but do not address the substance of the mentioned issues. These lie in the lack of good quality land-use planning based on well-defined and democratically agreed development goals set by municipalities. Officials issuing building permits for specific objects often do not know what may or may not be allowed since land-use plans are too general. It is indispensable to elaborate and approve a new building act, which will respect the international trends in urbanism and architecture and comply with good practice in other European countries. At the same time, particular characteristics of rural areas should be respected and informal planning tools supported, such as creation of local development plans for small villages as an expression of change from centralised planning to bottom-up planning.
