Abstract:

The goal of the United States and the European Union’s (EU) export control regime is to prevent the proliferation of goods and technology that might result in the harm of their national security interest and maintain technological superiority in dual-use technologies. Thus, the inclusion of the intangible technology transfers (ITT) in export control regimes have always been a staple for the United States and EU export control regime. However, with increased electronic transmissions that include the use of cloud technology services, the ways to maintain ITT export control compliance has never been more challenging. The recent regulatory changes made to U.S. export control regulation and the proposed regulatory changes made to E.U. export control regulation reflects this challenge. This paper analyzes the changes in regulatory revisions and the underlying policy implications of these regulatory changes.
